Prescreening Application for Development Under SB330 Submitted | 156 California Avenue
A new SB 330 pre-application was recently filed where the applicant asserts it qualifies as a Builder’s Remedy project. The location is 156 California Avenue – Mollie Stone’s Markets. The project includes a 17 story (177 feet) residential tower, an 11 story (123 feet) residential tower, and a 7 story (77 feet) mixed use building that will contain residential uses and a new 15,000 square foot Mollie Stone’s Market and other ancillary retail; no office is proposed. The project includes 382 residential units; 77 units are income restricted at 80% AMI. An SB 330 pre-application does not require any immediate action by the City. The applicant has 180 days from filing the pre-application to submit a formal application with the City, which begins the project review process.
The City’s position has been that the Builder’s Remedy does not apply because the City has an adopted Housing Element, which it believes is compliant with the basic requirements of state law. Notwithstanding this dispute, the City is committed to achieving HCD certification and is working diligently toward that goal.
